Terms of Service

These Terms of Service ("Terms") govern your use of the lessms Android application ("App") and the less.ms website ("Website"), collectively referred to as the "Service," operated by Pojava, LLC ("we," "us," or "our").

By downloading, installing, or using the App or visiting the Website, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

lessms is an Android application that acts as a default SMS/MMS app. It intercepts incoming messages, applies user-configured filter rules to route unwanted messages to a Junk folder, and provides standard SMS/MMS send and receive functionality. The Service is offered in two editions:

• Standard Edition — Free. Filter rules are visible but not enforced; the Junk folder shows a preview of what would be filtered.
• Focus Edition — A subscription purchased through Google Play, offered as a quarterly plan, an annual plan, or a prepaid year that does not auto-renew. Current prices are shown in the App at the time of purchase. Full active filtering; messages matching your rules are routed to the Junk folder and do not appear in your inbox and do not create message notifications.

The Service also includes an optional Spam Library: a public collection of spam examples contributed by users. Contributions are made only when you explicitly choose to submit a message, are processed on your device to remove personal details before being sent, and are reviewed by a person before being published. We may decline, reclassify, remove or withdraw any contribution at our discretion.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. The Service is intended for personal, non-commercial use.

3. Account Registration

Certain features of the Service (purchasing the Focus Edition, participating in the community forum, transferring your license to a new device) require you to create an account on the Website. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@pojava.com if you suspect unauthorized access.

4. License and Purchase

4.1 Standard Edition

The Standard Edition is provided free of charge. We grant you a limited, non-exclusive, non-transferable license to use the App for personal use.

4.2 Focus Edition

While you hold an active Focus Edition subscription, we grant you a limited, non-exclusive, non-transferable license to use the App with full filtering functionality for personal use. Your subscription is purchased and held through Google Play and is associated with your Google account, not with any particular device and not with your less.ms website account. Access ends when the subscription ends.

4.3 Changing Devices

Your subscription is held against your Google account, so signing in to Google Play on a new device restores it automatically. There is no transfer process, no limit on how often you may change devices, and nothing to request from us.

4.4 Trial Period

We offer a 30-day free trial of the Focus Edition, available once per device and started by you from within the App. No payment information is required and no subscription is created. When the trial expires, the App reverts to Standard Edition behavior unless you subscribe.

4.5 Billing, Cancellation and Refunds

Billing is handled entirely by Google Play. Auto-renewing plans renew at the end of each billing period until cancelled; a prepaid plan does not renew and simply expires. You may cancel at any time in your Google Play subscriptions, and cancelling leaves your access in place until the end of the period already paid for.

Refunds are governed by Google Play's refund policy and are requested through Google, not through us — we do not process payments and cannot issue refunds. If a technical issue is preventing you from using the Focus Edition, please contact us at support@pojava.com and we will try to resolve it.

5. Acceptable Use

5.1 General

You agree not to:

• Use the Service to intercept, block, or filter messages in violation of any applicable law.
• Reverse engineer, decompile, or disassemble the App.
• Attempt to circumvent the licensing or token verification system.
• Use the Service to send spam, harass others, or engage in any unlawful communication.
• Share, resell, or sublicense your Focus Edition license to others.
• Submit content to the Spam Library that is not unsolicited or unwanted messaging — in particular, personal correspondence, or messages from a person or organisation you simply wish to portray unfavourably.
• Submit content to the Spam Library that you know still contains another person's personal information, or that you have no right to share.
• Submit content designed to distort the Spam Library, including deliberately misleading examples or repeated submissions intended to inflate how often a message is reported.
• Use automated tools to access the Website or API at a rate that burdens our infrastructure.

5.2 Objectionable Content

Some parts of the Service carry content created by other users: community themes, community macro bundles, forum posts, and approved Spam Library entries. The following are objectionable content and are prohibited anywhere you can contribute to the Service. You may not submit, publish or distribute content that:

• Is sexually explicit, or sexualises a minor in any way.
• Promotes, threatens or glorifies violence, or incites others to it.
• Attacks, degrades or dehumanises a person or group on the basis of race, ethnicity, national origin, religion, disability, disease, age, sex, gender identity or sexual orientation.
• Harasses, bullies, impersonates or targets a specific person for abuse or ridicule, including publishing another person's private information.
• Facilitates or promotes illegal activity, or the sale of illegal or regulated goods.
• Is deliberately deceptive or malicious — including a macro bundle whose expansions insert content the user would not knowingly send, and content designed to mislead a reader about who wrote it or what it does.

Applied to the things this Service actually holds, this means: a theme's name and description, a macro bundle's name, description and every expansion it contains, a forum post, a profile nickname, and a Spam Library submission all have to meet this standard. A macro expansion is held to it particularly strictly, because macros are applied to messages you send — content that would put words into another person's outgoing message is prohibited whether or not it would be objectionable sitting on a page.

Separately from objectionable content, we may remove community content that is simply broken or unusable — a theme whose colours render the App unreadable, for example. That is a quality decision rather than a finding of misconduct, and carries no implication that the author did anything wrong.

5.3 Reporting and Moderation

The App provides a way to report a community theme or macro bundle from the screen where you encountered it, and to block a contributor so that their themes and macro bundles no longer appear for you. Blocking is a preference held on your device; it hides content from you and does not by itself remove anything or notify anyone.

Reports are reviewed by a person. We may remove content, refuse contributions, or revoke a contributor's or reporter's ability to participate, with or without a report having been filed and without prior notice. Removal is reversible and a removed item can be restored if we conclude the decision was wrong.

Spam Library contributions are reviewed by a person before publication rather than after, so nothing you submit is public until it has been approved. Approved entries carry no attribution to the contributor.

Your use of the Service is governed by these Terms, including this section, and by contributing content through the App you agree that your contribution is subject to them. Continuing to use the Service after a material change to this section means accepting the revised standard.

6. Third-Party Services

The App reads from and writes to the Android SMS/MMS content provider on your device. It does not route your messages through our servers; SMS and MMS messages travel through your mobile carrier's network as they normally would.

The App may use Google Sign-In for account authentication. Your use of Google Sign-In is subject to Google's Terms of Service and Privacy Policy.

7. Intellectual Property

All code, design, text, and other content comprising the App and Website are owned by us or our licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

Community themes and forum posts submitted by users remain the intellectual property of their authors. By submitting content to the Website — whether directly on the Website or by voluntarily contributing it to the Website through the App, as with the Spam Library — you grant us a non-exclusive, royalty-free, worldwide license to store, display, reproduce and distribute that content through the Service. The App presents the exact content to be contributed for your review before it is sent, and sends nothing unless you choose to submit it.

Spam Library contributions are published without attribution and carry no link to the contributor, so a contribution generally cannot be located and withdrawn on request once submitted. This license survives deletion of your account for that reason.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted or error-free.
• Filter rules will catch all unwanted messages or will not incorrectly filter legitimate messages.
• The Service will be compatible with all Android devices, carriers, or future versions of Android.

You are solely responsible for the filter rules you configure and their consequences, including any messages that are incorrectly routed to the Junk folder.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID FOR THE FOCUS EDITION IN THE 12 MONTHS PRECEDING THE CLAIM (OR ONE HUNDRED U.S. DOLLARS ($100) IF NO PAYMENT HAS BEEN MADE).

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms. You may stop using the Service at any time by cancelling your subscription in Google Play, uninstalling the App, and deleting your website account. Termination does not itself entitle you to a refund; refunds remain subject to Google Play's policy.

12. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms on the Website with a new effective date. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify registered users by email.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in McDowell Country, North Carolina, and you consent to personal jurisdiction in those courts.
